Terms of Service

1. Acceptance of Terms
By downloading, installing, or using NutriiFit AI ("the App"), you agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legal agreement between you and NutriiFit AI ("we," "us," or "our") — not with Apple Inc. If you do not agree to these Terms, do not use the App.
2. Description of Service
NutriiFit AI is an AI-powered calorie and nutrition tracking application for iPhone. The App provides the following features:
- AI-powered food photo recognition and nutrition estimation
- Barcode scanning with a database of 2.8M+ products
- Nutrition label scanning and OCR analysis
- Voice-based food logging
- Manual food search and logging
- Calorie, macro, and micronutrient tracking
- Water intake tracking
- Weight logging with trend analysis
- Progress analytics and charts
- Apple Health integration (reading activity/steps/weight, writing nutrition/water/weight)
AI analysis is powered by third-party services (Google Gemini API). Food database lookups use Open Food Facts and USDA FoodData Central.
3. Eligibility
You must be at least 13 years old to use the App. If you are under 18, you must have the consent of a parent or legal guardian. By using the App, you represent that you meet these age requirements.
4. License Grant
Subject to these Terms, we grant you a non-exclusive, non-transferable, revocable, limited license to download, install, and use the App on Apple-branded products that you own or control, in accordance with the Apple Media Services Terms and Conditions ("Usage Rules"). This license does not allow you to:
- Reverse engineer, decompile, or disassemble the App
- Modify, adapt, or create derivative works based on the App
- Distribute, sublicense, lease, rent, or lend the App to any third party
- Make the App available over a network where it could be used by multiple devices at the same time
- Remove, alter, or obscure any proprietary notices in the App
This license does not transfer ownership of any intellectual property.
5. Subscription Terms
5.1 Free Features
The following features are available at no cost:
- Manual food search and logging
- Basic calorie and macro tracking
- Water intake tracking
- Basic weight logging
- Static nutrition goals
5.2 Paid Features (NutriiFit Pro)
The following features require an active subscription:
- AI photo food recognition
- Describe meal (text-to-AI analysis)
- Barcode scanning
- Nutrition label scanning
- Voice-based food logging
- Adaptive calorie targets
- Weight trend charts and progress analytics
- Streaks and progress tracking
- Apple Health sync
- Meal reminders
5.3 Subscription Plans
- Weekly: $4.99/week (or localized equivalent)
- Yearly: $39.99/year (or localized equivalent)
Prices are set through Apple's App Store pricing and may vary by region and currency.
5.4 Auto-Renewal
Subscriptions automatically renew unless you cancel at least 24 hours before the end of the current billing period. Your Apple ID account will be charged for renewal within 24 hours prior to the end of the current period at the same price unless we notify you of a price change.
5.5 Cancellation
You can manage and cancel your subscription at any time through your iPhone settings:
Settings > [Your Name] > Subscriptions > NutriiFit AI
Cancellation takes effect at the end of the current billing period. You will retain access to paid features until the end of the period you have already paid for. No partial refunds are issued for unused portions of a billing period.
5.6 Refunds
All payments are processed by Apple through the App Store. Refund requests must be submitted directly to Apple in accordance with Apple's refund policy. We do not process refunds directly.
5.7 Restoring Purchases
If you reinstall the App or switch devices, you can restore your subscription using the "Restore Purchases" option within the App. Your subscription is tied to your Apple ID.
6. AI-Powered Features and Accuracy
6.1 AI Food Recognition
NutriiFit AI uses Google's Gemini 2.0 Flash API, a third-party artificial intelligence service operated by Google LLC, to estimate nutritional content from food photos, nutrition label images, voice transcripts, and typed meal descriptions. AI-generated nutritional estimates are approximations only and may not be fully accurate, complete, or reliable.
6.2 Third-Party AI Data Disclosure
In accordance with Apple's App Store Guidelines (5.1.2), we disclose the following about data shared with third-party AI:
- AI Provider: Google LLC (Gemini 2.0 Flash API)
- Data sent to Google Gemini: Food photos (images), nutrition label photos (images), voice transcripts (text only — not raw audio), and typed meal descriptions (text)
- Data NOT sent to Google Gemini: No personal identifiers (name, email, device ID, Apple ID), no Apple HealthKit data, no user profile data (age, gender, weight, goals), no location data, no raw audio recordings
- Data path: Your device → our stateless server-side API proxy (EAS Hosting / Cloudflare Workers) → Google Gemini API → response returned to your device. No data is logged or stored on our proxy.
- Google's data handling: On the paid API tier, your data is not used to train Google's AI models. Google may retain inputs for up to 55 days for safety and abuse monitoring, then deletes them.
- Consent: By using AI-powered features, you explicitly consent to this data processing. You are informed before your first AI interaction within the App.
6.3 Voice Logging and Audio Data
Voice-based food logging involves two distinct processing steps:
- Step 1 — Speech-to-Text (on-device): When you tap the microphone button on the Today screen, your voice is captured and processed entirely on your device by Apple's native iOS Speech Recognition framework (SFSpeechRecognizer). The raw audio recording is never transmitted to our servers, Google, or any third party.
- Step 2 — Text-to-Nutrition (AI): The resulting text transcript only (e.g., "two eggs and toast with butter") is sent through our server-side proxy to Google's Gemini API for nutritional analysis. Only the text is sent — no audio, no voice characteristics, no personal identifiers.
The microphone is activated only when you explicitly tap the microphone button. It is never activated in the background, during other app functions, or without your direct action. You can revoke microphone and speech recognition permissions at any time via iOS Settings.
6.4 No Guarantee of AI Output
- AI outputs may contain errors, inaccuracies, or omissions
- We make no warranty regarding the accuracy, completeness, or reliability of AI-generated nutritional data
- You are solely responsible for evaluating and verifying AI outputs before relying on them
- We are not liable for any decisions made based on AI-generated information
6.5 AI Usage Limits
Paid subscribers receive up to 30 combined daily AI-powered analyses (photo scan, label OCR, voice parse, describe meal). This limit resets daily at midnight. Barcode lookups use free public databases (Open Food Facts and USDA) and are not subject to this limit. We reserve the right to modify usage limits at any time.
6.6 Third-Party Services
The App integrates with the following third-party services, each governed by their own terms and privacy policies:

We are not responsible for the availability, accuracy, or conduct of third-party services.
7. Health and Medical Disclaimer
NutriiFit AI is not a medical device and is not intended to diagnose, treat, cure, or prevent any disease or medical condition.
7.1 General Wellness Only
The App is designed for general wellness and informational purposes only. Nutritional information, calorie calculations, macro targets, BMI data, and weight projections are estimates based on general formulas (Mifflin-St Jeor BMR equation) and should not be considered medical advice.
7.2 Consult a Healthcare Professional
You should consult a physician, registered dietitian, or qualified healthcare professional before:
- Starting any diet or exercise program
- Making significant changes to your eating habits
- Relying on the App's data for medical or dietary decisions
If you have a medical condition (including but not limited to diabetes, eating disorders, food allergies, or pregnancy), seek professional guidance before using the App.
7.3 Assumption of Risk
You assume all risks associated with using nutritional information provided by the App. We are not responsible for any adverse health outcomes resulting from reliance on the App's nutritional estimates, calorie targets, or weight-loss/gain projections.
7.4 No Professional Relationship
Use of NutriiFit AI does not create a physician-patient, dietitian-client, or any other professional healthcare relationship.
8. Apple HealthKit Data
If you choose to enable Apple Health integration:
- The App reads activity data (active energy burned, step count) and body mass from Apple Health
- The App writes dietary data (energy, protein, carbs, fat, water) and body mass to Apple Health
- All HealthKit access requires your explicit permission through Apple's system permission dialog
- Health data accessed through HealthKit is used solely for providing the App's nutrition and fitness tracking features
- Health data is never used for advertising, marketing, or data mining
- Health data is never sold to data brokers or shared with third parties
- Health data is never stored on remote servers or in iCloud
- You can disable HealthKit integration at any time within the App or via iOS Settings > Health > Data Access & Devices
9. Data and Privacy
All user data (food logs, weight entries, profile information, dietary preferences) is stored locally on your device using on-device storage. We do not operate cloud databases, do not create user accounts, and do not require login or registration. Subscription status is managed through Apple's App Store and RevenueCat using anonymous identifiers tied to your Apple ID.
9.1 Camera
The camera is used solely for food photo recognition, barcode scanning, and nutrition label scanning. Camera permission is requested only when you open the camera screen — never on app launch or in the background. Food photos are processed by Google's Gemini AI and not stored on any server after analysis.
9.2 Microphone and Speech Recognition
The microphone is used solely for voice-based food logging. It is activated only when you tap the microphone button. Voice audio is processed on-device by Apple's Speech framework and never transmitted to our servers or Google. Only the resulting text transcript is sent to Google's Gemini API for nutrition parsing. 9.3 Apple Health
HealthKit data is used solely for displaying activity context and syncing nutrition, water, and weight data. HealthKit data is never sent to Google Gemini, never used for advertising or data mining, and never stored on remote servers or in iCloud. See Section 8 for full details.

10. User Conduct
You agree not to:
- Attempt to circumvent subscription restrictions, AI usage limits, or other access controls
- Use the App for any unlawful purpose
- Submit false, misleading, or harmful content to AI analysis features
- Reverse engineer, decompile, or disassemble the App
- Attempt to access the App's server-side API routes directly outside of the App
- Interfere with or disrupt the App's services or servers
11. Intellectual Property
NutriiFit AI, including its design, code, algorithms, graphics, animations, and content, is owned by us and protected by copyright, trademark, and other intellectual property laws. "NutriiFit AI" and the App's logo are our trademarks.
You retain ownership of photos and other content you submit through the App. By submitting content for AI analysis, you grant us a limited, non-exclusive license to process that content solely for the purpose of providing the App's features. This license terminates when the content is no longer needed for processing.
We (not Apple) are solely responsible for investigating, defending, settling, and discharging any third-party intellectual property infringement claims related to the App.
12. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY OF AI OUTPUTS.
We do not warrant that the App will be uninterrupted, error-free, secure, or free of harmful components, or that any defects will be corrected.
13. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, OR DAMAGES ARISING FROM:
- Inaccurate nutritional estimates or AI analysis errors
- Adverse health outcomes from following the App's calorie targets, macro goals, or weight projections
- Data loss due to device failure, App uninstallation, or iOS updates
- Third-party service outages (AI services, food databases, Apple Health)
- Unauthorized access to or alteration of your data
OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE 12 MONTHS PRECEDING THE CLAIM.
If the App fails to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) of the App. To the maximum extent permitted by applicable law, Apple has no other warranty obligation with respect to the App.
14. Indemnification
You agree to indemnify, defend, and hold harmless NutriiFit AI and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from:
- Your violation of these Terms
- Your misuse of the App
- Your reliance on AI-generated nutritional information for medical or dietary decisions
- Any third-party claims related to your use of the App
15. Termination
15.1 By You
You may stop using the App at any time. Uninstalling the App terminates your license. Active subscriptions must be cancelled separately through Apple's subscription management (Settings > [Your Name] > Subscriptions).
15.2 By Us
We may terminate or suspend your access to the App at any time, with or without cause, including for violation of these Terms, abuse of AI features, or circumvention of usage limits.
15.3 Effects of Termination
Upon termination, your license to use the App is revoked. Sections that by their nature should survive termination will survive, including limitation of liability, indemnification, intellectual property, dispute resolution, and the Apple third-party beneficiary clause.
16. Product Claims
We (not Apple) are solely responsible for addressing any end-user or third-party claims relating to the App, including:
- Product liability claims
- Any claim that the App fails to conform to applicable legal or regulatory requirements
- Claims arising under consumer protection, privacy, or similar legislation
- Claims related to HealthKit data handling
17. Third-Party Terms
The App integrates with third-party services. By using the App, you agree to comply with the applicable terms of:
- Apple Media Services Terms and Conditions
- Google Gemini API Terms of Service
- Open Food Facts Terms of Use
We are not responsible for the content, policies, or practices of third-party services.
18. Legal Compliance
You represent and warrant that you are not located in a country subject to a U.S. Government embargo or that has been designated by the U.S. Government as a "terrorist supporting" country, and that you are not listed on any U.S. Government list of prohibited or restricted parties.
19. Apple as Third-Party Beneficiary
You acknowledge and agree that Apple, and Apple's subsidiaries, are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, Apple has the right (and is deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
20. Dispute Resolution
Any dispute arising from these Terms or your use of the App shall be governed by and construed in accordance with applicable law. Before initiating any formal proceedings, you agree to contact us at support@nutriifit.ai and attempt to resolve the dispute informally for at least 30 days.
21. Changes to These Terms
We reserve the right to modify these Terms at any time. Material changes will be communicated through the App or App Store update notes. Continued use of the App after changes constitutes acceptance. If you disagree with any changes, you must stop using the App.
22. Maintenance and Support
We are solely responsible for providing maintenance and support for the App. Apple has no obligation to furnish any maintenance or support services with respect to the App. For support inquiries, please contact us using the information below.

24. General Provisions
- Severability: If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force and effect.
- Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and us regarding the App.
- Waiver: Our failure to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.
- Assignment: We may assign these Terms without restriction. You may not assign your rights or obligations under these Terms.
